In June, Decree No. 800 came into force, which expands the application of life cycle contracts
The transition of the road industry to a life cycle contract system is one of the key tasks of the national project "Safe and High–quality Highways". By 2024, the share of LCC in the total volume of state and municipal contracts for road works should be 70%. This is one of the defining targets for the implementation of the national project.
"The life cycle contract is concluded for a full range of road works performed for more than three years. Its meaning is to assign responsibility for the condition and safety of the road, as well as for the result of the entire complex of works performed during the life of its operation, to a single company. This allows market methods to solve three problems of the industry at once: to improve the quality of road works, to make transparent control over the expenditure of funds and to oust unscrupulous performers from the market," ROSDORNIA explains in the FAA.
On 11.06.2020, the Government Decree of 01.06.2020, created on the basis of the developments and proposals of the FAA "ROSDORNIA", came into force Year No. 800, which made significant changes to sub–clause "a" in paragraph 1 of the Decree of the Government of the Russian Federation No. 1087 dated 28.11.2013 - one of the main normative acts in the development of the practice of applying life cycle contracts (hereinafter referred to as LCC) in the road industry.
In this connection, at the present time, CCC can be concluded, combining work on the construction, reconstruction, overhaul (and, if necessary, design and survey work) of highways (sections of highways) and their elements, and maintenance and (or) repair work. Previously, it was possible to conclude such a contract only in relation to design and construction work.
According to the Institute, Resolution No. 800 is only the first step towards achieving this goal. Thanks to him, state and municipal customers have received an effective and modern legal instrument that allows them to optimize the procedure for organizing public procurement and improve the quality of objects being built during the implementation of road activities. However, there is still a lot of work ahead, including the creation of the regulatory framework necessary for the successful application of FGC.
