On March 18, 2021, Russian Prime Minister Mikhail Mishustin held a Government meeting. One of the issues discussed was a draft law aimed at filling and updating the information on public roads contained in the system of control over the formation and use of funds of road funds of all levels (SKDF). We are talking about federal, regional, inter-municipal, local, as well as private highways. The document was developed by the Ministry of Transport of Russia within the framework of the national project "Safe and high-quality highways". In particular, the passport of the federal project "System-wide measures for the development of road facilities" provides for the adoption of regulatory legal acts obliging road owners to update data in the SKDF, as well as providing for liability for non-disclosure of such information.
"The system will contain up-to-date information about roads, about the history of road works, operational, statistical data on the activities of the road industry and other necessary data for effective road management," the Deputy Chairman noted The Government of the Russian Federation Marat Khusnullin.
According to the draft law, the Ministry of Transport of the Russian Federation is empowered to establish the procedure for creating, maintaining, operating, modernizing the SKDF, the composition of the information included in it, including the timing, methods, and procedure for providing information for inclusion in the SKDF.
With the introduction of such a system, Russians will have access to up-to-date information about the highway in relation to their place of residence. Citizens will be able to send messages about the quality of roads, as well as proposals for their development. Feedback is provided from the owners of highways, access to information about the repaired sections, information about the formation and expenditure of road funds with various details.
Road owners get the opportunity to enter and keep up-to-date data about their roads in digital form. Also, planning of road works, formation of programs for spending road funds, accounting and control of actual work will be available in the system.
A comprehensive and detailed analysis of information about highways and the history of the work carried out, taking into account the warranty, will become available to the authorities obligations, as well as an analysis of the items of formation and expenditure of road funds, operational and statistical industry indicators.
In turn, commercial organizations will have access to up-to-date and reliable information about highways, sections of road works and planned road works, accident-hazardous areas.
The road fund control system will contain the following information:
- information about the owners of highways, including concessionaires and private partners;
- names of roads, their identification numbers, as well as the length (including toll sections);
- information on the compliance of the road with the technical characteristics of the class and category, the type of permitted use, data on transport infrastructure facilities in the field of road management;
- information about road activities and activities planned and carried out within the framework of various programs;
- the results of the assessment of the technical condition of roads;
- information about contracts and procurement schedules in the field of road management;
- data on accidents and accident-hazardous areas with indication of their location;
- information on the formation and use of funds of the Federal Road Fund, road funds of subjects and municipalities;
- information about the condition of roads received from users;
- information about warranty periods and the cost of road works performed.
The new system will replace the current Unified State Register of Highways (EGRAD). The SKDF operator will ensure the transfer of data from Leningrad in full.
The adoption of the bill will create conditions for the creation, operation and modernization of the SKDF. In turn, this will ensure the unconditional fulfillment of the goals and objectives set by the national project "Safe and high-quality highways".
The absence of the necessary information in the SKDF or its distortion may lead to the failure to achieve the goals of effective use of the road network, as well as the inability to inform users about the condition of roads. In this regard, a separate bill proposes to amend the Administrative Code, assigning responsibility to the owners of highways for violating the procedure for providing information to the system. In particular, administrative fines They are provided against citizens, officials and legal entities for violating the procedure, deadlines for entering information, or submitting false information. Responsibility is also established in relation to the system operator.
The Federal Service for Supervision of Transport is proposed to be given the authority to draw up protocols and review cases of administrative offenses.
The proposed measures will ensure timely submission of information on 100% of the highways of the Russian Federation to the SKDF and their up-to-date maintenance. It will also increase the efficiency of the system and the level of interaction of road users.
